PLEASE READ THIS DISCLOSURE CAREFULLY BEFORE USING THIS APPLICATION. BY CHECKING THE ACKNOWLEDGMENT BOX AND PROCEEDING, YOU CONFIRM THAT YOU ARE AT LEAST 18 YEARS OF AGE, THAT YOU HAVE READ AND UNDERSTOOD THIS DISCLOSURE IN FULL, AND THAT YOU AGREE TO BE BOUND BY THESE TERMS.
1. What This Tool Is — And What It Is Not
The Wildfire Guardian Survivability Score (the "Score") is an informational modeling tool that estimates the relative likelihood that a specific residential structure may survive exposure to wildfire conditions, based on publicly available data and algorithmic modeling. It is provided to you, the homeowner or property owner, for your personal informational use only.
THE SCORE IS NOT ANY OF THE FOLLOWING:
- A guarantee, prediction, or warranty that your property will or will not survive a wildfire
- An engineering assessment, structural inspection, or certified fire-safety evaluation
- Insurance advice, a rate filing, an insurance rating factor, or an actuarial determination
- A substitute for consultation with a licensed insurance agent, structural engineer, or fire safety professional
- A government-issued fire safety certification or compliance determination of any kind
2. Informational Purpose — Your Score Belongs to You
Your Score is generated for your personal informational use. Wildfire Guardian, Inc. ("WG," "we," "us") does not share, transmit, sell, or provide your Score to any insurer, underwriter, managing general agent, surplus lines carrier, or other third party without your explicit, affirmative, prior consent.
Nothing in this application constitutes a recommendation to take or refrain from taking any action with respect to your property, insurance coverage, or financial affairs.
WG’s own conduct commitment: WG does not use the Score as an input to any underwriting, rating, eligibility, renewal, cancellation, or non-renewal decision on your behalf, and does not provide the Score to third parties for such purposes, except where you have affirmatively opted in as described in Section 3 below.
3. Optional: Request an Insurance Quote Using Your Score
You may, at your sole option, request that WG share your Score and associated property data with one or more licensed insurance carriers or their authorized agents for the purpose of obtaining an insurance quote. This is entirely voluntary.
IF YOU REQUEST AN INSURANCE QUOTE THROUGH THIS APPLICATION, YOU ARE EXPLICITLY CONSENTING TO THE FOLLOWING:
- WG will transmit your Score, the underlying property data used to generate it, and any contact information you have provided to one or more licensed insurance carriers or their authorized agents for insurance quoting purposes. Prior to transmitting your data to any specific carrier or agent, WG will identify that carrier or agent to you by name and provide you an opportunity to withdraw your consent before transmission occurs.
- You understand that the receiving carrier or agent will use your Score as one input among others in their independent underwriting and quoting process, subject to their own terms, disclosures, and applicable state insurance regulations.
- You understand that requesting a quote does not guarantee the availability, terms, or pricing of any insurance product.
- You understand that the carrier or agent receiving your Score is an independent third party. WG does not control, and is not responsible for, any underwriting decision, quote, offer, or denial made by any carrier or agent.
You may decline this option at any time by not checking the box. Declining does not affect your ability to receive your Score or use any other feature of this application.
4. Modeled Survivability Estimates and Score Deltas
Where this application displays a change in survivability probability (a "score delta") associated with property hardening measures or the application of fire-retardant products, including GraphGel™, the following applies:
- All score deltas are model-generated estimates derived from algorithmic inputs and third-party data. They are not engineering certifications, product performance guarantees, or actuarial determinations.
- Actual survivability outcomes are influenced by fire intensity, rate of spread, wind conditions, humidity, firefighting response, and other variables that no model can reliably predict.
- A positive score delta does not mean your property will survive a wildfire. A negative or unchanged score does not mean your property will not survive.
- Score deltas are provided to assist with comparative assessment only and should not be the sole basis for any property, financial, or insurance decision.
5. GraphGel™ Fire-Retardant Product — Specific Disclosures
GraphGel™ is a fire-retardant product licensed from a third party. WG deploys GraphGel™ as part of its property hardening services. WG is not the manufacturer of GraphGel™.
THE FOLLOWING DISCLOSURES APPLY TO ALL GRAPHGEL™-RELATED CONTENT IN THIS APPLICATION:
- Score improvements associated with GraphGel™ application are estimates derived from manufacturer specifications and controlled testing data. Real-world performance may vary materially from laboratory or controlled conditions.
- WG makes no independent representations about GraphGel™’s efficacy, durability, or performance under specific fire conditions.
- ASTM E84 and other laboratory ratings describe performance under standardized test conditions only. They do not represent performance under wildfire exposure conditions, which are materially and significantly different from controlled laboratory settings.
- The physical presence of GraphGel™ equipment on a property does not confirm application, adequate coverage, or product performance. On-site equipment is not a substitute for verified, documented application by a qualified professional.
- Any insurance premium adjustments, preferred-carrier designations, or coverage credits associated with GraphGel™ deployment are solely at the discretion of the applicable insurer and are not guaranteed or warranted by WG.
6. Data Sources, Accuracy, Currency, and Service Continuity
The Score is generated using data from the following sources, among others: public parcel records, USGS topographic data, CAL FIRE historical fire perimeter data, satellite-derived vegetation indices, and third-party wind modeling APIs.
WITH RESPECT TO ALL DATA SOURCES AND SERVICE CONTINUITY:
- WG does not independently verify the accuracy, completeness, or currency of third-party data.
- Data may be outdated, incomplete, or inapplicable to specific parcels due to the inherent limitations of publicly available data sources.
- Scores are generated as of the date of calculation and are not automatically updated. A previously generated Score may not reflect current conditions, recent fire activity, vegetation changes, structural modifications, or surrounding land use changes.
- WG expressly disclaims any warranty as to the accuracy, timeliness, or fitness for purpose of any data used to generate the Score.
- The Score depends on third-party data feeds, APIs, and services that may be interrupted, degraded, discontinued, or modified without notice. WG is not liable for any Score that is incomplete, delayed, or materially affected by third-party service interruption or data failure. In the event of a known data error that materially affects a Score, WG will endeavor to notify affected users, but assumes no obligation to do so.
7. State-Specific Insurance Regulatory Notice
The Score has not been submitted to, reviewed by, or approved by any state department of insurance. The Score does not constitute a filed insurance rating factor in any jurisdiction and is not regulated as an insurance rating or scoring tool by any state insurance regulator.
California Residents: This application is not affiliated with, approved by, or regulated by the California Department of Insurance. The Score is not a determination under the California FAIR Plan or any California-mandated insurance program. Nothing in this application modifies your rights or obligations under California Insurance Code.
Colorado Residents: This application is not affiliated with, approved by, or regulated by the Colorado Division of Insurance. The Score is not a determination under any Colorado wildfire mitigation or insurance rating program, including but not limited to programs established under Colorado Revised Statutes Title 10.
Utah Residents: This application is not affiliated with, approved by, or regulated by the Utah Insurance Department. The Score is not a certification under Utah HB 48 or any Utah WUI triage or certification program. Nothing in this application constitutes a determination by a state-recognized certifying authority under applicable Utah law.
8. Prohibited Uses — Insurance Eligibility Determinations
The Score is expressly not authorized by WG for use, by any party, as a standalone basis for any adverse action affecting a consumer’s eligibility for insurance, credit, employment, housing, or any other purpose regulated under the Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq., or any applicable state consumer protection statute.
As a condition of any data-sharing arrangement under Section 3, it is WG’s policy to require that any carrier or agent receiving a Score: (a) treat it as one informational input subject to independent underwriting verification; (b) comply with all applicable state insurance rating and filing laws; and (c) provide any required adverse action notice to the consumer under applicable federal and state law. These are obligations WG imposes on carriers through its own agreements with them — they are not imposed by this disclosure on carriers directly.
If you are a consumer and believe an insurance decision affecting you was based on your Score without your consent or proper legal process, contact the relevant insurer directly and consult qualified legal counsel regarding your rights.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- WG PROVIDES THIS APPLICATION AND ALL SCORES ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- IN NO EVENT SHALL WG, ITS OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS APPLICATION, RELIANCE ON ANY SCORE, OR ANY INSURANCE DECISION MADE BY A THIRD PARTY FOLLOWING YOUR CONSENT UNDER SECTION 3, EVEN IF WG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- WG’S TOTAL AGGREGATE LIABILITY TO YOU FOR DIRECT DAMAGES ARISING FROM USE OF THIS APPLICATION SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO WG IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00). THIS CAP APPLIES TO DIRECT DAMAGES ONLY AND DOES NOT EXPAND WG’S LIABILITY FOR CONSEQUENTIAL OR INDIRECT DAMAGES, WHICH ARE EXCLUDED ENTIRELY.
- SOME JURISDICTIONS, INCLUDING CALIFORNIA, DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN CATEGORIES OF DAMAGES. TO THE EXTENT SUCH LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY. IN SUCH JURISDICTIONS, WG’S LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY APPLICABLE LAW.
10. Privacy and Data Use
Property address, contact information, and any other personal data submitted through this application are used to generate and deliver your Score and for related service communications. WG does not sell personal data to third parties for marketing purposes.
Your data may be shared with service providers involved in Score generation, including mapping, satellite imagery, and data enrichment vendors, under appropriate data processing agreements. If you elect to request a quote under Section 3, your data will additionally be shared with the applicable insurer or agent as described in that section.
Marketing Communications — Opt-In Only:
WG will use your personal data and Score information for marketing purposes — including information about wildfire risk management, property hardening services, GraphGel™ deployment, and fire-retardant products offered by WG and its affiliates — only if you have separately and affirmatively opted in to marketing communications. If you have not opted in, your data will not be used for any marketing purpose, by WG or its affiliates, under any circumstances.
If you opt in, you may withdraw your consent at any time by clicking the unsubscribe link in any marketing communication or by submitting a written opt-out request to legal@thewildfireguardian.com. Withdrawal of consent does not affect the lawfulness of any marketing communications sent prior to your opt-out, and does not affect your ability to receive your Score or use any other feature of this application.
WG does not share opted-in marketing data with unaffiliated third parties for their own marketing purposes.
California Residents: You may have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know, correct, delete, and opt out of the sale or sharing of personal information. If you opt in to marketing under this section, WG may share your personal information with its affiliates for marketing purposes as described above, which may constitute “sharing” under the CPRA. You may opt out of such sharing at any time by contacting legal@thewildfireguardian.com or by using the unsubscribe mechanism in any marketing communication. Colorado and Utah Residents: You may have additional rights under the Colorado Privacy Act (CPA) and Utah Consumer Privacy Act (UCPA) respectively, including rights of access, correction, deletion, and opt-out of certain data processing. Your opt-in under this section may be withdrawn at any time consistent with those statutes. See our Privacy Policy for details.
11. Data Security and Breach Notification
WG implements commercially reasonable technical and organizational measures to protect personal data and Score information submitted through this application against unauthorized access, disclosure, alteration, or destruction.
In the event of a data security incident that involves unauthorized access to or disclosure of your personal information, WG will notify affected users in accordance with applicable state breach notification laws, including:
- California: notification in the most expedient time possible and without unreasonable delay, consistent with California Civil Code § 1798.82;
- Colorado: notification no later than 30 days following discovery of a breach affecting Colorado residents, consistent with C.R.S. § 6-1-716;
- Utah: notification in the most expedient time possible following discovery of a breach affecting Utah residents, consistent with Utah Code § 13-44-202.
Notification will be provided by email to the address associated with your account, or by in-app notice where email delivery is not practicable. WG’s security obligations do not extend to data processed or stored by third-party carriers or agents following your consent under Section 3; those parties are independently responsible for the security of data in their custody.
WG’s implementation of security measures does not guarantee that unauthorized access will never occur. No data transmission or storage system is completely secure. You use this application and submit personal data at your own risk with respect to security events beyond WG’s reasonable control.
12. Intellectual Property
The scoring methodology, algorithms, and engine underlying the Wildfire Guardian Survivability Score are the subject of one or more pending patent applications. All content, methodology, and outputs of this application are proprietary to Wildfire Guardian, Inc. and may not be reproduced, distributed, or used for commercial purposes without prior written authorization from WG.
GraphGel™ is a trademark of Altek Advanced Materials Inc., trademark registration pending. WG’s use of this mark in this application is authorized pursuant to a board resolution of Altek Advanced Materials Inc. Such use does not imply endorsement or certification by Altek Advanced Materials Inc. of any specific claim made by WG regarding survivability outcomes, product performance, or insurance outcomes.
13. Score Currency and Methodology Updates
Every Score reflects property conditions, data inputs, and modeling parameters as of the date of generation. Property conditions, vegetation, fire history, wind patterns, and surrounding land use change over time. WG recommends requesting a fresh Score before any major hardening decision, for general awareness purposes only and not as a substitute for professional advice.
WG may update, refine, or modify its scoring methodology at any time to incorporate new data, improved modeling, or regulatory requirements. A Score generated under a prior methodology may differ from one generated under a current methodology for the same property. Such differences reflect methodological improvement and do not constitute an error in either Score.
WG does not provide automatic Score refresh notifications. You are responsible for requesting a current Score when relying on this application for any consequential purpose.
14. Eligibility and Minimum Age Requirement
This application is intended solely for individuals who are at least 18 years of age and have legal capacity to enter into a binding agreement under applicable law. By proceeding, you represent and warrant that you meet these requirements.
WG does not knowingly collect personal information from individuals under the age of 13, consistent with the Children’s Online Privacy Protection Act (COPPA). Users under 18 are not authorized to use this application. If WG becomes aware that a user under 13 has submitted personal information, that information will be deleted promptly. If you are between 13 and 17 years of age, please do not use this application.
15. Indemnification
You agree to indemnify, defend, and hold harmless Wildfire Guardian, Inc. and its officers, directors, employees, agents, licensors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of this application in violation of these terms; (b) any false, inaccurate, or misleading information you submit through this application, including property data; (c) your misuse of the Score, including use for any purpose prohibited under these terms; or (d) any claim by a third party arising from your submission of data under Section 3 where such claim results from information you provided that was materially false or misleading.
WG agrees to indemnify, defend, and hold harmless you from and against any claims, liabilities, damages, and expenses arising directly from WG’s gross negligence or willful misconduct in the operation of this application, to the extent not otherwise excluded by the limitation of liability in Section 9.
This indemnification does not apply to claims arising from third-party carrier or agent decisions made independently following your consent under Section 3, which are governed by Section 9.
16. Governing Law, Arbitration, and Class Action Waiver
These terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
BINDING ARBITRATION:
Any dispute, claim, or controversy arising out of or relating to your use of this application, these terms, or any Score generated by this application shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, in Clark County, Nevada. Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending resolution of arbitration.
CLASS ACTION WAIVER:
YOU AND WG EXPRESSLY WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION, OR CLASS-WIDE ARBITRATION. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY. This waiver is a material and non-severable term of these terms. If a court finds this waiver unenforceable for any reason, the entire arbitration provision shall be null and void, and any dispute shall be resolved in a court of competent jurisdiction in Clark County, Nevada.
California Residents: Nothing in this section is intended to waive any right that cannot be lawfully waived under California law, including but not limited to rights available under the California Consumer Legal Remedies Act (CLRA) or California Unfair Competition Law (UCL) to the extent those statutes apply to your use of this application.
17. Changes to This Disclosure
WG reserves the right to update or modify this Disclosure at any time. For material changes — meaning changes that materially affect your rights, WG’s liability, the scope of data sharing, or the arbitration and class action provisions — WG will provide at least thirty (30) days’ prior notice by email to the address associated with your account and by prominent in-app notification.
During the 30-day notice period, you may discontinue use of the application and your prior version of these terms will continue to govern any claims arising before the effective date of the change. If you continue to use the application after the 30-day notice period has elapsed, you will be deemed to have accepted the updated terms.
For non-material changes — such as corrections of typographical errors, updated contact information, or clarifications that do not affect your rights — WG will update the Effective Date and version number above, and changes will take effect immediately upon posting.
